1. Operator Identity

The website https://roatanquebecois.ca and related services (Messenger, WhatsApp, Telegram, email) are operated by Patrice Bouffard, under the brand Roatan Québécois. The agency operates primarily from Roatán (Honduras), serving clients mostly from Quebec and Canada.

2. Nature of Services Offered

Roatan Québécois is a travel intermediary that:

• 🌊 Directly operates certain excursions in Roatán (West Bay snorkeling, Pigeon Cay, island tour — Roatan Québécois products)
• ✈️ Resells packages from Canadian wholesalers (Sunwing Vacations / WestJet Travel Group, Air Canada Vacations, WestJet Vacations) — flight + hotel
• 🏨 Coordinates hotel stays with Roatán resorts (Infinity Bay, Mayan Princess, Henry Morgan, Fantasy Island, etc.)
• 🚐 Arranges transfers airport ↔ hotel and excursions on the island
• 💬 Serves as a communication channel in English, French & Spanish for clients (before, during, and after travel)

3. Booking Process

1. Request: You send me a request via web form, Messenger, email, WhatsApp, or phone.
2. Proposal: I reply with a detailed proposal (price, dates, hotel, flight, options).
3. Booking: You confirm in writing (email or Messenger) your agreement with the proposal.
4. Payment: You pay according to agreed terms (deposit + balance, or full payment).
5. Confirmation: I forward the booking to the appropriate service provider(s) (wholesaler, hotel) and send you the confirmation document.

4. Pricing and Payments

4.1 Price Display

• Prices on the website are indicative and may vary by date, availability, wholesaler inventory, and USD↔CAD exchange rates.
• No hotel prices are displayed in real-time (per Quebec's Travel Agencies Act A-10, which only permits prices verifiable at display time).
• Final pricing is confirmed in the written proposal.

4.2 Payment Methods Accepted

• 🇨🇦 Interac e-transfer (Canada-based clients)
• 📃 Bank transfer (case by case)

All payments are in US dollars (USD) unless otherwise noted. CAD↔USD conversions are your responsibility per your card or institution's rate.

4.3 Deposit and Balance

• Excursions: 50% deposit at booking, balance on the day of the excursion.
• Flight + hotel packages: per wholesaler policy (typically 30% deposit at booking, balance 45 days before departure).

5. Cancellation and Modification Policy

5.1 Roatan Québécois Excursions

• ✅ 30+ days before: Full refund
• 🟡 15–30 days before: 50% refunded, 50% retained
• 🔴 Less than 15 days: Non-refundable (except documented force majeure)
• 🌦️ Cancellation by Roatan Québécois (weather, unsafe seas, technical issue): Full refund OR reschedule to your chosen date

5.2 Wholesaler Packages

Cancellation terms for Sunwing, Air Canada Vacations, and WestJet Vacations packages are the wholesaler's — I have no discretionary power over them. Generally:

• 60+ days: Moderate cancellation fees
• 30–60 days: 50% of package retained
• Under 30 days: Typically non-refundable

I strongly recommend travel insurance (cancellation, medical, evacuation) with any package booking. I can refer you to a provider if you don't already have coverage.

6. Force Majeure

Neither Roatan Québécois nor its partners are liable for cancellations or changes caused by force majeure events: hurricanes, cyclones, earthquakes, pandemics, border closures, strikes, government actions, airline or hotel operational issues.

Recent example: the early termination of Sunwing's YQB-Roatán flight on March 3, 2025 (versus the announced March 31) is typical. In such situations, I commit to finding you the best alternative and coordinating with the wholesaler to minimize your loss — but I cannot guarantee a full refund if the wholesaler doesn't provide one.

7. Limitation of Liability

Roatan Québécois acts as an intermediary between you and final service providers (airlines, hotels, transfer operators, restaurants). As such:

• ❌ I am not liable for airline cancellations or delays (Air Canada, Sunwing, WestJet, etc.)
• ❌ I am not liable for hotel service defects (hot water outage, buffet quality, etc.) — I help resolve with the hotel
• ❌ I am not liable for accidents during optional third-party activities (scuba diving with a third-party operator, scooter rental, etc.)
• ✅ I am liable for the quality of excursions I directly operate (Tuesday, Wednesday, Friday)
• ✅ I am liable for accurate information transmission between you and service providers

For directly-operated excursions, my maximum liability is limited to the amount you paid for the excursion.

8. Traveler Safety and Obligations

• 🛂 Valid Canadian passport 6 months beyond your return date — it's your responsibility to verify
• 🛂 Visa not required for tourist stays under 90 days in Honduras (Canadian citizens)
• 💊 Travel insurance strongly recommended (medical + cancellation)
• 📞 Emergency number: Keep my WhatsApp (+504 3327 5203) accessible during your trip
• 🌊 Water activities: You confirm you can swim for snorkeling excursions. Life jackets available for non-swimmers.

9. Intellectual Property

All website content (text, photographs, videos, drone footage, icons) is the property of Patrice Bouffard or used under license. Underwater photos, aerial views, and client testimonials (with consent) are protected by Canadian copyright.

Permitted uses without request: sharing a page URL, short quotations with a backlink. Prohibited uses without written permission: copying more than 200 words, reproducing photos, commercial use, automated scraping.

10. Affiliate System (Referrers)

The site uses a simple affiliate system (URL ?ref= or ?affiliate_name) that stores an identifier in your browser for 90 days. If you book through me within 90 days, the referrer who sent you may receive a commission per our agreement.

This system costs you nothing and does not increase your travel price — the commission comes from my margin.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Province of Quebec, Canada. Any dispute will be subject to Quebec courts (at the discretion of the traveler or the agency).

12. Modifications

I may modify these terms at any time. The version applicable to your booking is the one in effect at the time of your confirmation. Future modifications do not affect already-confirmed bookings.
